The actress was seen being shoved to the ground at one point.
According to footage acquired by TMZ, the actress can be heard yelling his name as she tries to drag him away from the group outside the Sunset Marquis hotel on Thursday night, while a woman in the other party screams, ‘Back the f**k up.’
Security reportedly managed to get the situation under control for a while, but Hickerson got loose, escalating the situation once again. He is said to have spat on someone in the party, prompting the management of the upscale pub to kicked everyone out.
“While in the restaurant of the Sunset Marquis Brian Hickerson, who happened to be with Hayden, made a comment to an individual about leaving the waitress a poor tip. That same individual along with the group he was with began badgering and shoving Brian at which point security pushed everyone outside,” the actress’ representative told PEOPLE in an exclusive statement.
“Brian was attacked by the group as was Hayden who in her best effort tried to diffuse the situation. Hayden was refused the opportunity to provide a statement to the police as she was escorted back inside. She is okay.”
The West Hollywood station of the Los Angeles County Sheriff’s Department verified to US Magazine that someone from the hotel phoned the cops at 12:18 a.m. in relation to a brawl outside.
It was also confirmed by the publication that authorities did not file a report, since “upon deputies’ arrival there was no evidence of a crime,” and “there was nobody complaining of pain, and no one came forward saying they were a victim of an assault.”
Back in 2021, after the actress charged him of domestic assault in 2018, Hickerson was sentenced to 45 days in prison and four years probation. In addition, he was required to undergo 52 domestic violence seminars, pay $500 in reparations, and be subject to a five-year protection order.
He was detained on various criminal counts, namely assault with a dangerous weapon, corporal harm to a spouse/cohabitant, and threatening Panettiere. He was also accused of violence on a spouse or cohabitant, which was a misdemeanor allegation.
