Stephen ‘tWitch’ Boss Died Without A Will, His Widow Is Seeking Control Of His Estate

Many people were shocked by his passing, and Holker now has the responsibility of handling his affairs.

At the age of 40, Stephen “tWitch” Boss passed away unexpectedly in December 2022, perhaps by suicide. He was most recognized for his work on the television program “So You Think You Can Dance,” and since he died without leaving a will, his widow Allison Holker has filed for control of his estate.

In the absence of a will, Holker will have to go through the probate procedure to take possession of her husband’s assets. Mainly if disputes exist over the division of the estate, this can be a lengthy and challenging procedure.

With that being said, in response to the renowned dancer’s sudden death without leaving a will, Holker is requesting a California court to grant her access to Stephen’s share of their joint estate, according to court records that PEOPLE was able to gain access on Wednesday.

In situations like this, a California Spousal Property Petition is often filed, and that is what Stephen’s widow did on Monday in the Superior Court of California in Los Angeles County, as this procedure is done to prove their legal position as the deceased spouse even if the California law states that a surviving spouse is entitled to their deceased spouse’s share of their joint assets.

The application also mentions details concerning Allison and Stephen’s marriage, which Allison thought would establish her status as Stephen’s surviving husband. Even more clearly stated was the fact that following their wedding, Stephen did not acquire any property “through a gift, joint tenancy, life insurance,” or any other beneficiary.

Secondly, it was made clear that Stephen and Allison had no formal arrangements stipulating how their assets would be distributed and that they had resided in California throughout their entire marriage.

Holker likewise included a “determination of property passing to the surviving spouse” and “confirmation of property belonging to the surviving spouse” as part of her request. In addition, she lists the assets, including quasi-community assets, that she wants the court to decide she should be awarded as Stephen’s surviving husband.

As stated in part in court records, “this includes any interest in a trade or business name of any unincorporated business or an interest in any unincorporated business that the deceased partner was operating or managing at the time of death.”

Not to mention, the court filing states that Allison is requesting Stephen’s ownership interest in Stephen Boss Productions, the Goldman Sachs investment account, and royalties from Cast and Crew Production Services, Disney Worldwide Services, Inc., GEP Talent Services, LLC, and SAG/AFTRA.

Besides that, although Stephen’s wife filed for control of the estate, she made it plain that she was not requesting the administration of his assets. 

At the time of Stephen’s passing, Allison came into a Los Angeles Police Department station in a state of panic because she said Stephen had left the house without his car—something that was very unlike him.

A hospital in Los Angeles received a call later reporting a medical emergency. It appears that Stephen committed suicide by shooting himself when he was found dead inside the motel. His death was pronounced at the site.

She subsequently released a statement to confirm his passing, saying, “It is with the heaviest of hearts that I have to share my husband Stephen has left us.”

“Stephen lit up every room he stepped into. He valued family, friends, and community above all else, and leading with love and light was everything to him. He was the backbone of our family, the best husband and father, and an inspiration to his fans. To say he left a legacy would be an understatement, and his positive impact will continue to be felt.”

As she concluded her remark, she expressed confidence that they would always remember him. She also asks for privacy during this challenging period for her and especially for their three children [Zaia, Maddox, and Weslie,] adding, “Stephen, we love you, we miss you, and I will always save the last dance for you.”
